السعودية: شابان معرضان لخطر الإعدام الوشيك بعد صدور حكم المحكمة العليا بحقهما سرًا

قالت دانا أحمد، باحثة معنية بالشرق الأوسط في منظمة العفو الدولية، تعقيبًا على معلومات موثوقة تلقتها منظمة العفو الدولية تفيد بأن المحكمة العليا في السعودية أيدت سرًا حكمَيْ الإعدام الصادرَيْن بحق شابَّيْن كانا دون سن 18 عامًا وقت ارتكاب جرائمهما المزعومة، دون إخطار عائلتيهما أو محاميهما:“أدين عبدالله الدرازي وجلال لباد بتهم تتعلق بالإرهاب بسبب مشاركتهما في احتجاجات مناهضة للحكومة في محاكمات فادحة الجور اعتمدت في المقام الأول على اعترافات مشوبة بالتعذيب. لقد حكمت عليهما السلطات السعودية بالإعدام، ونكثت بوعودها بالحد من استخدام عقوبة الإعدام بحق الأشخاص الذين كانوا أحداثًا في وقت ارتكاب الجرائم المزعومة. ويمكن الآن إعدام الشابان في أي لحظة بعد أن يصدق الملك على أحكام الإعدام الصادرة بحقهما، بعد استنفاذ جميع سبل الانتصاف القانونية المحلية.ندعو الملك إلى الامتناع عن التصديق على أحكام الإعدام الصادرة بحق هذين الشابَّيْن وندعو السلطات المختصة إلى إلغاء أحكام الإعدام الصادرة بحقهما لوضع حد لهذا الاستخفاف بالعدالة.

كما يجب على السلطات فتح تحقيق في مزاعم المتهمين بالتعرض للتعذيب وغيره من ضروب المعاملة السيئة، المسجلة في وثائق المحكمة التي اطلعت عليها منظمة العفو الدولية، بما في ذلك الضرب المبرح والعنف الجنسي والصعق بالكهرباء، والتي تقاعست المحكمة عن التحقيق فيها”.

خلفية

في مايو/أيار 2023، أكدت هيئة حقوق الإنسان السعودية في رسالة إلى منظمة العفو الدولية أن “تطبيق عقوبة الإعدام على الأحداث في جرائم التعزير قد ألغي نهائيًا”. وجرائم التعزير التي أدين بهما الشابان هي جرائم لا تنص الشريعة الإسلامية على تطبيق عقوبة الإعدام فيها.

وفي 16 أكتوبر/تشرين الأول 2023، أعرب خبير في الأمم المتحدة عن قلقه إزاء الإعدام الوشيك لعبدالله الدرازي ودعا السلطات السعودية إلى النظر في اعتماد وقف اختياري لاستخدام عقوبة الإعدام وإجراء مراجعة منهجية لجميع القضايا التي حكم على المتهمين فيها بالإعدام، لا سيما تلك التي تشمل متهمين من الأحداث.

وتحظر اتفاقية الأمم المتحدة لحقوق الطفل التي صادقت عليها السعودية حظرًا صارمًا توقيع عقوبة الإعدام على الأشخاص الذين كانت أعمارهم تقل عن 18 عامًا في وقت وقوع الجريمة.

وتُعارض منظمة العفو الدولية عقوبة الإعدام في جميع الحالات بلا استثناء، وبغض النظر عن طبيعة الجريمة أو ملابسات ارتكابها؛ أو كون الفرد مذنبًا أو بريئًا، أو غير ذلك من سمات الفرد؛ أو الطريقة التي تستخدمها الدولة في تنفيذ الإعدام.

والسعودية هي إحدى أكثر الدول تنفيذًا لعقوبة الإعدام في العالم. وسبق أن أعدمت السلطات السعودية 112 شخصًا بين يناير/كانون الثاني وأكتوبر/تشرين الأول 2023. في 2022 وحده، أعدمت المملكة 196 شخصًا، وهو أعلى عدد من عمليات الإعدام السنوية التي سجلتها منظمة العفو الدولية في البلاد خلال السنوات الـ 30 الماضية.
