منظمة العفو الدولية تصدر تقريرا شاملا عن وضع حقوق الإنسان الكارثي في السعودية: قتل وتعذيب وسجن بدون وجه حق

استهدفت السلطات أشخاصًا بسبب ممارستهم السلمية لحقوقهم في حرية التعبير وتكوين الجمعيات أو الانضمام إليها. وحاكمت المحكمة الجزائية المتخصصة، وأصدرت أحكامًا بحق أشخاص بالسجن لمدد طويلة في أعقاب محاكمات فادحة الجور، بسبب التعبير عن آرائهم أو تكوين الجمعيات أو الانضمام إليها على نحو سلمي، أو بسبب تكوينهم لمنظمات مجتمع محلي. وتعرّض مدافعون عن حقوق الإنسان لمضايقات داخل السجون، وأُصدِرَت قرارات تعسفية بمنعهم من السفر، بعد الإفراج المشروط عنهم. ولجأت محاكم إلى عقوبة الإعدام بعد محاكمات فادحة الجور، بما في ذلك في حالات أشخاص كانوا أطفالًا في وقت وقوع الجرائم المزعومة. وأُعدِم أشخاص على خلفية مجموعة واسعة من الجرائم. وأُخضع الآلاف من السكان لعمليات الإخلاء القسري في مدينة جدة الساحلية. وظلّ العمال الأجانب يتعرضون للإساءة والاستغلال بموجب نظام الكفالة، بينما اُحتُجِز الآلاف تعسفيًا في ظل أوضاع لاإنسانية، وتعرّضوا للتعذيب وغيره من ضروب المعاملة السيئة؛ وأُعيدوا بصورة غير طوعية إلى بلدانهم الأصلية، في إطار حملة قمعية شُنَّت على مستوى البلاد ضد المهاجرين الذين لا يحملون وثائق قانونية. ودخل نظام الأحوال الشخصية، الأول من نوعه في البلاد، حيز النفاذ، وقد قنّن نظام ولاية الرجل والتمييز ضد النساء.

خلفية

عَيَّن الملك سلمان، في 27 سبتمبر/أيلول، ولي العهد الأمير محمد بن سلمان رئيسًا لمجلس الوزراء، وهو منصب كان يتقلَّده الملك سابقًا، وشكّل ذلك استثناءً للنظام الأساسي للحكم.

وفي مارس/آذار، أصدر أعضاء بارزون بالبرلمان الأوروبي بيانًا بشأن أوضاع حقوق الإنسان في المملكة العربية السعودية، أدانوا فيه عمليات الإعدام الجماعي التي جرت في 12 مارس/آذار، وحثوا البلاد على فرض وقف فوري لتنفيذ أحكام الإعدام.

وفي يوليو/تموز، زار الرئيس الأمريكي جو بايدن المملكة العربية السعودية. وفي وقت لاحق من الشهر نفسه، أصدرت السعودية بيان جدة الذي يُوضح أوجه الشراكة الاستراتيجية بين البلدين، ولم يشمل أي التزامات بشأن حقوق الإنسان.

وفي 6 نوفمبر/تشرين الثاني، عقدت السعودية والاتحاد الأوروبي الحوار الثاني بشأن حقوق الإنسان بالرياض، عاصمة البلاد. وأعرب الاتحاد الأوروبي عن بواعث قلق بشأن الزيادة الحادة في عمليات الإعدام، فضلًا عن قضايا أخرى متعلقة بحرية التجمع وتكوين الجمعيات أو الانضمام إليها واستخدام أوامر منع السفر.

وواصل التحالف بقيادة السعودية تورُّطه في ارتكاب جرائم حرب وانتهاكات جسيمة أخرى للقانون الدولي في النزاع المسلح الدائر منذ أمد طويل في اليمن (انظُر باب اليمن).

حرية التعبير وتكوين الجمعيات أو الانضمام إليها

أدانت المحكمة الجزائية المتخصصة 15 شخصًا على الأقل، من المواطنين والأجانب، وحكمت عليهم بالسجن لمدد تراوحت بين 15 و45 عامًا، بعد محاكمات فادحة الجور بسبب تعبيرهم السلمي عن آرائهم، بما في ذلك التعبير السلمي على الإنترنت عبر تويتر، أو تكوينهم للجمعيات أو الانضمام إليها. وحكمت المحكمة أيضًا على ناشطتيْن لحقوق المرأة، على الأقل، بالسجن لمدد طويلة على نحو غير مسبوق.

كما واصلت المحكمة الجزائية المتخصصة، ومحاكم أخرى، فرض شروط تقييدية على أشخاص مُفرَج عنهم خلال العام اللاحق لانتهاء مدد سجنهم. تضمنت منعهم من السفر، وإغلاق حساباتهم على منصات التواصل الاجتماعي.

في 9 أغسطس/آب، حكمت المحكمة الجزائية المتخصصة، خلال جلسة استئناف، على طالبة الدكتوراة والناشطة سلمى الشهاب بالسجن لمدة 34 عامًا، يتبعه منع من السفر لـ34 عامًا، بسبب كتاباتها ونشاطها السلمي على تويتر الداعم لحقوق النساء في السعودية. وطالبت النيابة بتشديد العقوبة بعد أن حُكِم عليها بالسجن لمدة ستة أعوام في بادئ الأمر. واستندت العقوبة المشددة إلى تقدير القاضي لمعاقبتها على “الإخلال بالنظام العام وزعزعة أمن المجتمع واستقرار الدولة”، بنشرها تغريدات على تويتر، وذلك بموجب المواد 34 و38 و43 و44 من نظام مكافحة الإرهاب، والمادة 6 من نظام مكافحة جرائم المعلوماتية.1

وحكمت المحكمة الجزائية المتخصصة على 10 مصريين نوبيين بالسجن لمدد تراوحت بين 10 أعوام و18 عامًا، بعد محاكمة فادحة الجور في 11 أكتوبر/تشرين الأول، بسبب تنظيمهم فعالية سلمية لإحياء ذكرى تاريخية.2 وقد أمضى الرجال أكثر من عاميْن قيد الحبس الاحتياطي التعسفي.

المدافعون عن حقوق الإنسان

ظلّت منظمات حقوق الإنسان محظورة بموجب نظام الجمعيات والمؤسسات الأهلية. وظل النشطاء والمدافعون عن حقوق الإنسان يتعرضون للاحتجاز التعسفي، والمضايقات في أثناء احتجازهم، أو يخضعون لأوامر منع السفر التعسفية التي تُقَيَّد حريتهم في التنقل. واستمر العشرات في قضاء أحكام بالسجن على خلفية عملهم في مجال حقوق الإنسان.

وأُفرِج عن المُدوِّن والناشط رائف بدوي في مارس/آذار، إفراجًا مشروطًا، بعد أن أمضى 10 أعوام في السجن على خلفية إنشائه منتدى للحوار العام على الإنترنت اتُهم بسببه بإهانة الإسلام. وبدأ تنفيذ إجراء المنع من السفر لمدة 10 أعوام، كجزء من الحكم الصادر ضده.3

حُرم محمد القحطاني، المدافع الحقوقي والعضو المؤسس لجمعية الحقوق المدنية والسياسية في السعودية (حسم)، من التواصل مع عائلته من أكتوبر/تشرين الأول حتى نهاية العام. وفي مايو/أيار، تعرّض للاعتداء على يد سجين آخر في نفس عنبره، كان يعاني من مشكلات في الصحة العقلية.

عقوبة الإعدام

حكمت السلطات بالإعدام على أفراد أُدينوا بالقتل العمد والسرقة والاغتصاب وتهريب المخدّرات وجرائم متعلقة بالإرهاب، وأعدمتهم عقب محاكمات فادحة الجور.

وفي فبراير/شباط، أخبرت هيئة حقوق الإنسان السعودية منظمة العفو الدولية أن سلطات البلاد لم تعُد تنفِّذ الإعدام في حالات “الجرائم التي ارتكبها قاصرون”، وأنها خففت جميع الأحكام المعلّقة في هذه القضايا. ومع ذلك، أيَّدت المحكمة الجزائية المتخصصة ومحكمة جزائية أخرى، بين يونيو/حزيران وأكتوبر/تشرين الأول، أحكام إعدام بحق ثلاثة شُبّان، كانت تقل أعمارهم عن 18 عامًا في وقت ارتكاب جرائم يُعاقَب عليها بالإعدام.4

وأُعدِم 81 رجلًا من المواطنين والأجانب في 12 مارس/آذار، في إطار أكبر عملية إعدام جماعي في العقود الأخيرة. ووفقًا لما ذكرته وزارة الداخلية، كان أولئك الذين أُعدِمُوا قد أُدينوا بمجموعة من الجرائم، تضمنت جرائم متعلقة بالإرهاب والقتل والسطو المسلح وتهريب الأسلحة. وأُدين بعضهم بـ “السعي لزعزعة النسيج الاجتماعي واللُحمة الوطنية” و”الدعوة إلى والمشاركة في الاعتصامات والمظاهرات”، التي تُعَد مسميات تصف أفعالًا تحظى بحماية الحقوق في حرية التعبير والتجمع السلمي وتكوين الجمعيات أو الانضمام إليها. وتضمّن الأشخاص الذين أُعدِمُوا 41 شخصًا من الأقلية الشيعية في المملكة العربية السعودية.5

وفي نوفمبر/تشرين الثاني، أعدمت السلطات 20 شخصًا على خلفية جرائم متعلقة بالمخدّرات، وكانت هذه العمليات الأولى من نوعها منذ إعلان هيئة حقوق الإنسان السعودية، وقف استخدام عقوبة الإعدام للمعاقبة على الجرائم المتعلقة بالمخدّرات في يناير/كانون الثاني 2021.

المحاكمات الجائرة

في أبريل/نيسان، أيَّدت المحكمة العليا حكميْن بالإعدام ضد رجلين شيعييْن بحرينييْن، بتهم تتعلّق بـ”الإرهاب” والتظاهر. وكانا قد اعتُقِلا في 8 مايو/أيار 2015، واحتُجِزا بمعزلٍ عن العالم الخارجي في زنازين انفرادية لثلاثة أشهر ونصف. وفي أكتوبر/تشرين الأول 2021، حكمت المحكمة الجزائية المتخصصة عليهما بالإعدام، عقب محاكمة فادحة الجور. وسيواجهان خطرًا وشيكًا بتنفيذ إعدامهما، في حالة تصديق الملك على حكميهما.6

وفي مارس/آذار، حكمت محكمة جزائية في مدينة تبوك بالإعدام مُجددًا على عبدالله الحويطي، الذي اعتُقِل حين كان عمره 14 عامًا، بعد أن نقضت المحكمة العليا في نوفمبر/تشرين الثاني 2021 حكم إعدام سابق صادر بحقه في أكتوبر/تشرين الأول 2019. وفي يونيو/حزيران، أيَّدت إحدى محاكم الاستئناف في تبوك حكم الإعدام. واحتُجز عبدالله الحويطي، في أثناء فترة الحجز، في الحبس الانفرادي، ومُنِع من الاتصال بمحاميه وأُرغِم على “الاعتراف” تحت وطأة الإكراه. وحُوكِم بتهم تضمنت السطو المسلح وقتل ضابط أمن عمدًا.7

عمليات الإخلاء القسري

منذ يناير/كانون الثاني حتى أكتوبر/تشرين الأول، أخضعت السلطات آلاف السكان، بينهم أجانب، في جدة لعمليات إخلاء قسري، في إطار خطة عمليات هدم وإخلاء جماعية لتطوير المدينة. وفي 31 يناير/كانون الثاني، أعلنت إحدى منافذ الإعلام الموالية للدولة، عن برنامج لتعويض المواطنين، استثنى الأجانب الذين مثَّلوا 47% من السكان الذين أُخلُوا من منازلهم. وكان السكان قد تلقوا إخطارات قبل الهدم بمدد تراوحت بين يوم واحد وستة أسابيع. وقد انتُهِيَ من خطط المشروع منذ حوالي ثلاثة أعوام، إلا أن السلطات لم تُجرِ مشاورات حقيقية مع السكان، ولم تُقدم إليهم إخطارات مُسبقة بمدة كافية، ولم تُعلن عن حجم التعويضات، ولم تقدمها إليهم قبل عمليات الهدم.8

حقوق المهاجرين

وفي يوليو/تموز، أعلنت وزارة الموارد البشرية والتنمية الاجتماعية شرطيْن جديديْن، في إطار إجراء إصلاحي محدود لنظام الكفالة، أصبح بإمكان العمال المنزليين بموجبهما تغيير أصحاب العمل بدون الحاجة إلى تصريح من أصحاب عملهم الحاليين، إذا أنهوا عقود عملهم في أثناء فترة التدريب، وإذا توفَّر ما يُثبت أن خدماتهم قد انتقلت إلى أصحاب عمل آخرين، بدون الحاجة إلى علم أو موافقة أصحاب العمل السابقين. ومع ذلك، لم يُوفِّر الشرطان الجديدان الحماية للعمال المنزليين الأجانب من الانتهاكات الأخرى التي ظلّوا يتعرضون لها، ومن بينها الإساءات اللفظية والبدنية، ومصادرة جوازات سفرهم، ودفع أجورهم بصورة غير منتظمة أو الامتناع تمامًا عن دفعها.

واستمر استثناء العمال المنزليين الأجانب من إجراءات الحماية المنصوص عليها في قانون العمل السعودي.

وواصلت السلطات حملتها القمعية ضد الأشخاص المتهمين بانتهاك أنظمة الإقامة والحدود والعمل بالاعتقالات التعسفية، وأعادت عشرات آلاف المهاجرين الإثيوبيين قسرًا، بسبب أوضاعهم غير النظامية المتعلقة بالهجرة فقط (انظُر القسم التالي بعنوان التعذيب وغيره من ضروب المعاملة السيئة).

وبحسب ما ذكرته وزارة الداخلية، بين يناير/كانون الثاني ونوفمبر/تشرين الثاني، أُعيد ما لا يقل عن 479,000 من الأجانب إلى بلدانهم الأصلية من بين 678,000 معتقلين بسبب “مخالفة أنظمة الإقامة والعمل وأمن الحدود”. وفي أثناء الفترة نفسها، اعتُقِل 14,511 أجنبيًا، معظمهم إثيوبيون ويمنيون، لدخولهم إلى السعودية عبر الحدود مع اليمن بصورة غير نظامية.

التعذيب وغيره من ضروب المعاملة السيئة

احتجزت السلطات السعودية رجالًا ونساءً وأطفالًا إثيوبيين على نحو تعسفي لمدد وصلت إلى 18 شهرًا، في ظل أوضاع لاإنسانية وعرَّضتهم للتعذيب وغيره من ضروب المعاملة السيئة، قبل إعادتهم قسرًا إلى إثيوبيا، معظمهم بين أبريل/نيسان ومايو/أيار لمجرد وضعهم غير النظامي المتعلق بالهجرة. واحتُجزوا في زنازين مكتظة بالنزلاء، بدون أن يُوفّر لهم ما يكفي من الطعام والمياه ومرافق الصرف الصحي والرعاية الصحية داخل مركزي احتجاز قبل ترحيلهم. وتُوفي 12 رجلًا، على الأقل.9

حقوق النساء والفتيات

في مارس/آذار، أَقَرّ مجلس الوزراء نظام الأحوال الشخصية الجديد، الذي دخل حيز النفاذ في يونيو/حزيران. ويجيز النظام الجديد، الذي لم يكُن مقننًا قبل ذلك، ممارسة التمييز ضد النساء، بما في ذلك بواسطة نظام ولاية الرجل عليها. فبموجب هذا النظام، لا يمكن إلا للرجال أن يكونوا أوصياء قانونيين، وينبغي للمرأة أن تحصل على إذن وليّها الذكر للزواج، وتُلزم بطاعة زوجها بعد ذلك. إضافةً إلى ذلك، لا يعطي النظام النساء والرجال حقوقًا متساوية في الشؤون المتعلقة بأطفالهم في حالة الانفصال. وفي حين تُمنح الأم الحضانة بشكل تلقائي، يُعتبر الأب وصي الطفل القانوني بدون النظر على النحو الواجب في المصالح الفضلى للطفل.10

التقاعس عن التصدي لأزمة المناخ

لم تُعلِن الحكومة بعد عن مساهمتها الجديدة المحددة وطنيًا.
